Snap Wants to be a State Actor??–Kansas v. Snap

Kansas Attorney General Kobach sued Snap for deceptive and addictive practices, and while Snap attempted to keep the case in federal court by claiming it acted under direction of federal officers (DHS and FDA), a court granted Kobach's request to remand it to state court. By arguing it was working under federal direction, Snap has created a significant legal liability by providing evidence that could be used by future plaintiffs to argue Snap functions as a state actor, which would subject it to constitutional restrictions on content moderation.
